The American Council of Engineering Companies of New Jersey has filed a protest with the Fort Monmouth Economic Revitalization Authority (FMERA), charging that its December 28, 2011 RFP for Surveying Services violates the federal Brooks Act.
In a letter issued today to FMERA leadership, ACECNJ called for the RFP to be rescinded and amended to incorporate the qualifications based selection (QBS) process for selection of the services provider.
The Brooks Act is a long-standing federal law that requires engineering and design related services to be procured through a QBS process. The Brooks Act applies to projects receiving federal funding, including the Surveying Services included in FMERA’s recent RFP.
